What background checks are legally permitted in Poland?
Background checks in Poland are legally restricted. Criminal record checks, sourced from Poland's National Criminal Register, are only permissible for positions that are required to have a clear criminal record by a specific statutory law, including finance sector roles or top management positions. Credit checks via the National Register of Debtors need a PESEL or NIP number and are restricted to roles carrying significant financial responsibility.
Every check needs explicit, informed written consent, governed by GDPR, the Polish Personal Data Protection Act, and the Polish Labour Code.
What is a zaświadczenie o niekaralności and do employers need it?
A zaświadczenie o niekaralności is a Certificate of Clear Criminal Record, sourced from Poland's National Criminal Register.
Employers can only request it for specific roles, mainly finance sector positions and senior management. It isn't a general-purpose background check. For most other roles, employers are limited to verifying what the candidate has told them directly: employment history, qualifications, and references.
