In Taiwan, employers may not request unnecessary information from job applicants, including medical records, psychiatric test results, and personal information like criminal records and credit scores. They may use third parties to conduct background checks if the information is necessary for the job or required in the public interest, and if the job applicant provides their consent. Third parties are only allowed to collect publicly available data. Before any data is collected, the employer must inform the employee of the details and their rights under the Personal Data Protection Act. Foreign employees must have work permits to work in Taiwan, which must be renewed every three years, and specific industries may require additional documentation. Employers may not conduct background checks or drug tests prior to employment.
