In Ljuxemburg, immigration compliance is required for employment. During the recruitment process, an employer must ensure that the employee undergoes a medical check with a practitioner from the occupational health service that the employer is affiliated with. The practitioner will determine if the employee's health allows them to take on the role in question. This medical check is mandatory regardless of the nature of the work. In certain cases, the employer may also be required to organize regular medical exams during employment. Reference and education checks are permitted with the applicant's consent as long as they comply with data protection and privacy regulations and are relevant to the position. The employer may also request criminal record information from applicants for the purpose of human resources management and recruitment. If the employer decides not to hire the applicant, the criminal record must be destroyed immediately. If the applicant is hired, the employer can only retain the criminal records for one month.
